Legal and Ethical Behavior

5% of the CNA exam · blueprint NNAAP Written (Oral) Examination Content Outline, effective April 2024

Short answer

Three of the 60 scored items. It covers legal and ethical conduct, confidentiality, the state nurse aide registry and what is recorded on it, and the consequences of findings of abuse, neglect or misappropriation of resident property. The registry entry itself is a federal requirement and candidates must be told about it in advance.

Why it matters on this exam

Three items, and mostly discrete facts that either stick or do not. Study it briskly and late — it is five percent.

Key concepts

Common mistakes

Worked example

An aide notices a resident's ring is missing and another staff member suggests waiting to see if it turns up. The correct action is to report it through the facility's process, without delay and without investigating first. Misappropriation of resident property is recorded on the registry, and the duty at 483.152(b)(7)(v) and (vi) is to maintain security of possessions and to report instances of mistreatment — not to establish what happened before saying anything.

Original practice questions

Legal and Ethical BehaviorDifficulty 2/5

Within what period must successful completion be entered on the state nurse aide registry?

  1. ASixty days from the date the individual is found to be competent
  2. BNinety days from the date the individual is found to be competent
  3. CTwelve months from the date the individual is found to be competent
  4. DThirty days from the date the individual is found to be competent
Show answer and rationale

Correct: D. Section 483.154(e)(2) sets thirty days. Section 483.154(a) separately requires the state to tell candidates in advance that successful completion will be recorded on the registry.

  • A — Sixty days is not the period the regulation specifies.
  • B — Ninety days is not the period the regulation specifies.
  • C — Twelve months relates to the reimbursement provision, not to registry entry.
Legal and Ethical BehaviorDifficulty 2/5

An aide runs out of time and charts care that was not actually provided. How is this best characterised?

  1. AFalsification of the record, which is a legal and ethical breach
  2. BAn acceptable shortcut, provided the care is given later that shift
  3. CA documentation error to be corrected at the next opportunity
  4. DA supervision issue to be resolved between the aide and the nurse
Show answer and rationale

Correct: A. Recording care that did not happen misleads everyone who relies on the record, including the licensed nurse making decisions from it. The exam treats it as a legal question, not a paperwork one.

  • B — Charting in advance of care is falsification regardless of the intention to catch up.
  • C — An error is unintentional; recording care known not to have been given is not.
  • D — Supervision may be a factor, but the act itself is a falsified record.
